The recipient of the RAST/CHEF software and documentation agrees to the following guidelines and restrictions:
Use and Distribution Guidelines
The RAST/CHEF software and documentation is available at no charge to those organizations and individuals (recipients; user) responsible for managing process safety risks.
Limitation of Liability
AIChE, CCPS, EPSC and The Dow Chemical Company have used their best efforts to deliver complete data incorporated into the RAST/CHEF software and documentation. Nevertheless, AIChE, CCPS, EPSC and The Dow Chemical Company do not warrant accuracy or completeness, are not responsible for errors and omissions, and are not liable for any direct, indirect, or consequential damages flowing from the recipient's use of RAST/CHEF.
The RAST/CHEF software and documentation is being distributed "as is" and the AIChE, CCPS, EPSC and The Dow Chemical Company do not make any warranty claims, either expressed or implied, with respect to the RAST/CHEF software and documentation, their quality, accuracy, completeness, performance, merchantability, or fitness for any intended purpose.
Indemnification
All recipients shall indemnify and save harmless AIChE, CCPS, EPSC and The Dow Chemical Company, their agents and employees against any and all loss, damage, claim, or liability whatsoever, due to personal injury or death, or damage to property of others directly or indirectly due to the use of the RAST/CHEF software and documentation by the recipient, or any other act or omission of the recipient, including failure to comply with the provisions of these terms and conditions.
