An Insider’s View of the New Patent Laws

Robert Stoll, who recently ended his government service as the Commissioner for Patents, teaches practitioners about the complexities of the new America Invents Act. He explains how patentees can better protect their valuable patents and how challengers can advantage their positions in contesting competitors’ patents. He provides insights about the factors to evaluate when deciding whether to use the new Inter Partes Review procedures and the Post Grant Review procedures or to go to the courts instead. He discusses the tactics that would provide the best outcomes in both procedures.

Mr. Stoll details how the new Supplemental Examination procedures will function and talks about the changes to inequitable conduct in the United States. He provides insight relating to some recent case law decisions and tips about how to improve your chances of getting a good patent from the USPTO
